Welcome to BeBalanced Natural Hormone Weight Loss (“BeBalanced,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the website located at bebalancedcenters.com and any related subdomains, pages, forms, or online services (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.\

 

1. No Medical Advice or Provider-Patient Relationship

IMPORTANT — PLEASE READ CAREFULLY. BeBalanced is a wellness program focused on natural hormone balancing, nutrition, and lifestyle coaching. BeBalanced specialists, wellness coaches, and center staff are not licensed medical providers. Nothing on this Site — including text, graphics, testimonials, assessments, blog posts, videos, or any other content — constitutes medical advice, diagnosis, or treatment, and no provider-patient relationship is created by your use of the Site or by participation in our programs.

The information on this Site is provided for general informational and educational purposes only. It is not a substitute for professional medical advice. Always seek the advice of your physician or other qualified health provider before starting any weight loss program, supplement regimen, diet, or lifestyle change, and before making any decisions related to your health or a medical condition. The Site and our programs are intended for users who are at least 18 years of age. The names “BeBalanced,” “BeBalanced Natural Hormone Weight Loss,” “Becoming Balanced,” and related logos are trademarks of BeBalanced and may not be used without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal, non-commercial use. Any other use — including reproduction, modification, distribution, public display, or creation of derivative works — is strictly prohibited without our prior written permission.

 

6. Hormone Assessments, Consultations, and Submitted Information

The free hormone assessment, consultation booking forms, and other interactive tools on the Site are educational screening tools only. They do not diagnose any medical condition and are not a substitute for evaluation by a licensed healthcare provider. By submitting information through these forms, you:

  • Confirm that all information you provide is accurate and truthful to the best of your knowledge;
  • Consent to being contacted by BeBalanced or an authorized local BeBalanced center by phone, email, or text message at the contact information you provide;
  • Acknowledge that your information will be handled in accordance with our Privacy Policy.

 

7. SMS / Text Messaging Consent

By providing your phone number on any form on the Site, you agree to receive informational text messages from BeBalanced Centers regarding appointments, programs, promotions, and wellness content. Consent is not a condition of purchase. Message frequency will vary. Message and data rates may apply. You may reply HELP for help or STOP at any time to cancel. Carriers are not liable for delayed or undelivered messages.

 

8. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources (such as news outlets, social media platforms, payment processors, or scheduling tools) that are not owned or controlled by BeBalanced. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of any third-party site is at your own risk and subject to that site’s terms and policies.

 

9. Individual Centers and Franchise Locations

BeBalanced operates through a network of centers across multiple states, including California, Connecticut, Florida, Maryland, Michigan, Minnesota, New Hampshire, New York, Pennsylvania, Texas, and Virginia. Individual centers may be independently owned and operated. Pricing, program availability, hours of operation, and specific services may vary by location. Any agreement you enter into with a specific BeBalanced center for programs or services is a separate agreement between you and that center and is governed by the terms provided to you by that center at the time of enrollment.

 

10. Payments, HSA/FSA, and Insurance

BeBalanced specialists are not licensed medical providers and do not accept health insurance. Many clients are able to use HSA or FSA funds to pay for our programs; however, eligibility is determined by your plan administrator, not by BeBalanced. You are solely responsible for confirming with your HSA/FSA provider whether a particular expense is reimbursable.

 

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BEBALANCED DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, current, or reliable.

 

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEBALANCED, ITS OFFICERS, DIRECTORS, EMPLOYEES, OWNERS, FRANCHISEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, ANY CONTENT ON THE SITE, OR ANY PROGRAM OR SERVICE REFERENCED ON THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

 

13. Indemnification

You agree to defend, indemnify, and hold harmless BeBalanced, its parent company, franchisees, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any false information you provide through the Site.

 

14. Modifications to the Site and Terms

We reserve the right to modify, suspend, or discontinue the Site (or any portion of it) at any time, with or without notice. We also reserve the right to update these Terms at any time. Revised Terms will be posted on this page with an updated “Effective Date.” Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

 

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Lancaster County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

 

16. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

 

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when enrolling in a specific program or at a specific center, constitute the entire agreement between you and BeBalanced regarding your use of the Site and supersede any prior agreements.
